These terms are an agreement between you and BTECK about using nadwati, including the apps coaches publish with nadwati. By creating an account or using the service you accept them, along with our Privacy policy. If you use nadwati for a business, you accept them on its behalf.
Your account
You must be at least 13 years old to use nadwati; if you are under 18, a parent or guardian must agree to these terms for you. Give accurate information, keep your password to yourself, and tell us at contact@nadwati.com if you think someone else has used your account. You are responsible for what happens under it.
Coaches and their programs
A coach who creates a space runs their own program in it. We provide the software: we are not a party to any agreement between a coach and their students, and we don't provide, supervise or guarantee any coaching. Each coach is responsible for their program, what they publish, how they treat their students and the information they record about them. Students never pay a coach through nadwati; any such payment is between the student and the coach.
Subscriptions
- A new space starts with a free trial of 14 days that includes the Pro plan's features. Nothing is charged during the trial.
- Paid plans are billed monthly in US dollars, in advance, through Stripe, and renew every month until cancelled. The plans, their prices and what each includes are shown in the app before you buy.
- You can cancel in the app at any time. The space keeps working until the end of the period you paid for; partial periods are not refunded, except where the law requires it.
- When you change plans, Stripe prorates the difference on your next invoice.
- If a payment fails, or a trial ends without a paid plan, the space keeps working for 7 days. After that it is suspended, and its members can't use it until a payment is made. We keep the space's data while it is suspended.
- If we change our prices, we will tell you before a new price applies to you.
Your content
You keep ownership of what you put into nadwati: your profile, messages, files and posts. You give us a worldwide, non-exclusive, royalty-free license to host, store, copy, process and display that content only as needed to run the service for you and the people you share it with — for example, showing a coach's post to their students, or a public post on a space's public page. You confirm that you have the right to share what you upload.
Acceptable use
Don't use nadwati to:
- break the law, or help someone else break it;
- upload content you don't have the rights to, or content that is unlawful, threatening, harassing, hateful or sexually exploitative;
- share someone's personal information without their permission;
- send spam or malicious code;
- access accounts, spaces or data that aren't yours, or probe, disrupt or overload the service;
- copy or scrape the service, or resell access to it, without our written permission.
Video sessions
nadwati does not record meetings or live sessions held in its built-in video rooms. Don't record, capture or stream a session, or share what other participants say or show, without the consent of everyone taking part. A coach may use another video service through a link instead; that service's own terms apply there.
Suspension and closing
You can stop using nadwati and delete your account at any time. A coach can block a member of their space. We may suspend or close an account or a space that breaks these terms, puts other people at risk, or that the law requires us to act on — and, for a coach, a space whose subscription goes unpaid, as described above. Where it is reasonable, we will tell you first.
Disclaimers
We work to keep nadwati available and to improve it, and its features may change. To the fullest extent the law allows, the service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't promise that it will be uninterrupted or error-free, or that any coaching will produce a particular result.
Limitation of liability
To the fullest extent the law allows, BTECK is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim about the service is limited to the greater of what you paid us in the 12 months before the claim and 100 US dollars. Some places don't allow these limits, so they may not apply to you.
Indemnity
If you are a coach, you will defend and compensate BTECK for claims that arise from your program, your content or how you handle your students' information.
Changes to these terms
We may update these terms. If a change is significant, we will tell you in the app or by email before it takes effect; using nadwati after that means you accept the new terms.
